In a stern warning to both the national workforce and private sector companies, the UAE Ministry of Human Resources and Emiratization (MoHRE) has emphasized the serious consequences of engaging in false Emiratization practices. This unethical behavior, aimed at circumventing the goals of Emiratization, not only undermines the country’s labor policies but also deprives deserving people of opportunities.
What is false emiratization?
False Emiratization encompasses several deceptive practices, including:
- Hiring UAE nationals in nominal positions without actual job responsibilities.
- Rehire UAE nationals in their current roles within the same company, simply to meet Emiratization quotas.
These practices are designed to exploit loopholes in Emiratization policies, known as Nafis, for personal gain.
Legal Actions and Sanctions:
To deter such misconduct, the MoHRE has established strict penalties:
- Fines ranging from AED 20,000 to AED 100,000 per incident for offending companies.
- Referral of the offending company to the Public Ministry, depending on the seriousness of the infraction.
- Lower the classification of the offending company within the Ministry’s system.
- Force the company to achieve genuine Emiratization objectives.
- Demand financial contributions for Emiratization goals.
- Suspension of Nafis benefits for UAE citizens involved in false emiratization.
- Recover any financial benefits received by UAE nationals involved in such practices.
