New UAE rule: Ministry of Human Rights to resolve disputes worth Dh50,000 or less between private sector companies and workers

Dubai: The Ministry of Human Resources and Emiratization (MoHRE) has announced that it will resolve disputes worth Dh50,000 or less brought to its attention and related to private sector companies and workers, domestic workers and domestic worker recruitment agencies with final executive decisions. starting January 1, 2024.

This decision also applies to disputes related to the lack of commitment to friendly settlement decisions previously resolved by the Ministry regardless of the amount claimed.

The new process aims to save customers time and effort, streamline procedures and speed up the process for claimants to collect their legal entitlements, according to a MoHRE statement issued on Monday.

Federal law

The updated mechanism is in line with Federal Decree-Law No. 20 of 2023 Amending Certain Provisions of Federal Decree-Law No. 33 of 2021 on the Regulation of Labor Relations, and Federal Decree-Law No. 21 of 2023 That Modifies Certain Provisions of Federal Decree-Law No. 9 of 2022 on Domestic Workers.

The new amendments allow any party to a dispute to file a claim with the Court of Appeal within 15 working days of notification of the Ministry’s decision to resolve the dispute. The court then schedules a hearing within three business days.

Common procedures

The Ministry will continue with its usual procedures, working to find amicable solutions for disputes exceeding Dh50,000 and referring cases where an amicable solution could not be reached to the corresponding court for resolution within a maximum period of 15 business days. from the date of submission. .

The amendments serve to speed up the resolution of labor complaints referred to the judiciary, improving compliance with legal obligations between workers, employers and domestic worker recruitment agencies, and reducing the number of irregular workers.
