UAE: Sheikh Mohammed bin Rashid signs new law for Dubai Executive Council

Dubai: In his capacity as Ruler of Dubai, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the United Arab Emirates, issued Law No. 26 of 2023 concerning the Executive Council (TEC) of Dubai.

The Act highlights the objectives of the TEC, which include implementing the leadership’s vision to foster a prosperous society, address the needs of citizens, ensure a good standard of living, encourage and ensure citizen participation in key sectors, promote sustainability and well-being. of the community and actively contribute to safeguarding the security and stability of the citizens, residents and visitors of the emirate.

Under the law, the Council also seeks to improve Dubai’s position among the world’s major cities and improve its position in global competitiveness indices in various spheres. Other responsibilities of the Council include approving strategic policies and plans, ensuring continuous improvement of government performance, presenting plans and programs that further boost Dubai’s distinguished global reputation, tracking the progress of projects and initiatives approved by the Government of Dubai and approving the creation or modernization of government entities before submitting proposals to the Ruler of Dubai for final approval, as well as improving the emirate’s legislative and regulatory frameworks, among others.

The new law also outlines the process for appointing the Chairman of the Executive Council, stipulating that it will be carried out by a decree issued by His Highness the Ruler of the Emirate. In addition, the law defines the responsibilities of the President of the Council, detailing the selection processes of the Vice Presidents, the Secretary General of the Council and its members. In addition, it specifies the functions of the President, the Vice Presidents and the members of the Council.

Strategic issues

Law No. 26 of 2023 also forms the ‘Strategic Affairs Council’ as an affiliate of the Executive Council. The law also establishes responsibilities of the Strategic Affairs Council, including the approval of public policies for the emirate of Dubai in various strategic fields. It also authorizes the Strategic Affairs Council to present these policies to the Executive Council for approval, in addition to reviewing the Dubai Strategic Plan and presenting it to the Executive Council for approval.

This involves raising performance standards in various strategic sectors, monitoring global competitiveness indicators relevant to the emirate of Dubai, and presenting essential plans to improve the emirate’s global position to the Executive Council for approval, among other functions.

Law No. 26 of 2023 also outlines the authority of the Chairman of the Strategic Affairs Council, as well as the operational processes for both the Dubai Executive Council and the Strategic Affairs Council.

General Secretary

The Law also provides for the establishment of a General Secretariat for the Executive Council composed of a Secretary General and one or more deputies, together with a team of experienced and specialized staff with varied knowledge. The Law clearly establishes the powers and powers of the General Secretariat, empowering it to provide support and assistance to the Executive Council, the Strategic Affairs Council, as well as the councils, committees or working groups formed by them to help in their decision-making process. of decisions. .

The Law also establishes the tasks and responsibilities of the General Secretariat in supporting the Executive Council and the Strategic Affairs Council in the context of approving public policies and making decisions or strategic approaches of Dubai, as well as leading the preparation and updating the Dubai Strategic Plan, among others.

The General Secretariat is also tasked with providing information on federal and local legislative projects presented by relevant government entities. This is to ensure its complete alignment with the adopted strategies and policies.

In addition, the General Secretariat will also present an annual report to both the Executive Council and the Strategic Affairs Council, detailing the results of the Dubai Strategic Plan. He will also oversee programs dedicated to excellence and leadership in government operations while actively contributing to the improvement of government performance, among others.

The responsibilities of the General Secretariat will also include the preparation and evaluation of the comprehensive government structure, incorporating the government’s operational mechanisms. This role involves suggesting essential modifications to improve the effectiveness and efficiency of the government in accordance with good governance principles, among other tasks.

Law No. 26 of 2023 outlines the process for appointing the Secretary General of the Executive Council of Dubai, which will be carried out by a decree issued by His Highness the Ruler of the Emirate on the recommendation of the Chairman of the Executive Council. . The Law also establishes powers of the Secretary General of the Council.

The President of the Executive Council will issue the decision necessary to implement the Law, which replaces Law No. 3 of 2003 relating to the creation of the Executive Council. In addition, the new Law also annuls Executive Council Resolution No. 40 of 2015 regarding the powers of the General Secretariat of the TEC, and Executive Council Resolution No. 66 of 2017 regarding the formation of the Strategic Affairs Council as part of the TEC. . The Law nullifies any other legislation that contradicts it.

The decisions and regulations implemented under Law No. 3 of 2003, Executive Council Resolution No. 40 of 2015 and Executive Council Resolution No. (66) of 2017 will remain in force until new decisions and regulations are issued that the replace.

Law No. 26 of 2023 comes into force from the date of its issuance and will be published in the Official Gazette.
